This Privacy Policy describes how we collect, use, store and protect the personal information you provide to us through encroachmentbn.com. By accessing our services or using our platform, you accept the practices described in this document in accordance with the General Data Protection Regulation (GDPR) and Spain's Organic Law on Data Protection and Guarantee of Digital Rights (LOPDGDD).

We only collect data strictly necessary for the provision of our services.
4. Purpose of Processing
Your personal data is processed for the following purposes: management of your account and investor profile, processing and monitoring of investments in real estate projects, compliance with legal and regulatory obligations (anti-money laundering, tax regulations), communications related to contracted services, improvement of our platform and user experience, and sending commercial information about new investment projects when you have given your express consent.
5. Legal Basis for Processing
The processing of your data is based on: the execution of the financial intermediation services contract, compliance with legal obligations arising from participatory financing platform regulations, your express consent for commercial communications, and the legitimate interest of Encroachmentbn in improving its services and preventing fraud.
6. Data Sharing
Your personal data may be communicated to: real estate project developers to the extent necessary for the execution of the investment, banking entities for payment and transfer management, regulatory and tax authorities as required by applicable legislation, and technology service providers acting as data processors under confidentiality agreements. We do not sell or transfer your personal data to third parties for commercial purposes.
7. Data Retention
Your personal data will be retained for the time necessary for the provision of contracted services and, subsequently, during the applicable legal retention periods. Data relating to financial operations will be retained for a minimum of 10 years in accordance with anti-money laundering legislation. Browsing data will be retained for a maximum of 24 months.

In accordance with the GDPR and LOPDGDD, you have the right to: access your personal data, rectify inaccurate or incomplete data, request the deletion of your data when no longer necessary, object to processing in certain circumstances, request restriction of processing, data portability to another controller, and not to be subject to automated decisions.
